Alternatives to Court Action
Court Action may be costly and it is sometimes cheaper, quicker and easier to consider mediation or arbitration.
Many contracts specify that disputes will be resolved by arbitration or mediation and experts can often cost less than the court process.
We are able to offer mediation as an alternative dispute resolution procedure. Daniel Gearing is an accredited independent mediator and can mediate in matters for non clients and existing clients provided we have no prior knowledge of the particular dispute and the other party agrees to appoint us. Often, what the parties really need is an independent person who can guide them and help clarify the real legal issues and advise them on what is likely to happen if a dispute is not settled. Even if mediation is not entirely successful, it usually enables both parties to resolve some issues and therefore save costs. Mediation can offer several advantages. It avoids a judge deciding the matter for you. You can reach a settlement that the courts cannot make, for example continued business relationships can be streamlined and monitored. Usually an settlement is more likely to be accepted as you agree it rather than have it imposed on you.
