Daniel Gearing

Litigation Partner

Daniel specialises in employment, commercial and contractual disputes. He also has experience in matrimonial cases and is a qualified mediator.

Daniel trained in Lincolns Inn fields, London after completing his LPC in Store Street, London. He qualified in 1999 and a year after qualification, he left London to move to Sanders to develop the litigation department and be closer to his family. He became the litigation partner in 2003.

He has a large range of experience from conducting small claims hearings to multi million pound High Court trials. “I start with the presumption that most lawyers know the law, though this is not always the case. What makes one lawyer better than another is a proactive, realistic (in terms of settlement and costs) and determined approach. Negotiation skills are often overlooked but a good negotiator will often get a better result regardless of the actual merits of a case. Tactics are sometimes more important than the law!” Daniel believes that if a case has to “go to Trial” it is generally because “the parties are unreasonable and either have no confidence in their lawyer or reject the lawyers advice or because the lawyers are inexperienced or misleading the client”.

With a range of experience in contract disputes, Daniel also drafts contract, terms of business and other commercial agreements. “Having an insight on what can go wrong and having seen various pitfalls in contracts which often only arise once there is a dispute, enables me to foresee potential problems and ensure they are catered for in advance.” “How can one advise a client on contractual terms in non contentious matters when you have little or no experience in the disputes that arise from such terms?”

Daniel is married, has been a member of Hornchurch Round Table since 2003, has run several marathons and regularly competes in triathlons across the country.
